As to whether what the police are doing in Ferguson is potentially unconstitutional: It's probably going to be debated. But there's no way for us to say whether it is or isn't at this point. Wonkblog raises some of these points with a bit more context.
Also, I happen to be hardcore from St. Louis and I love that town, which is why I have this Twitter list of a lot of strictly local St. Louisans who happen to mostly be in Ferguson now and working with folks there. I think it's an interesting peek into what's happening.
